Agreement |

|
An
agreement between RASST and the Agent/Broker is deemed to be
effective when written, electronic (e-mail or via website) or verbal
instruction is issued to RASST by the agent/broker or their
assistants. The person or persons making the request by written,
electronic (e-mail or via website) or verbal instruction for any
action by RASST will ultimately be the financially responsible
party. RASST will then carry out the instruction and charge the
appropriate fee (if any) in accordance with the terms and conditions
stated below: |

Installations |

Standard
Installation Fee |
| |
|
The Standard
Sign Post Installation fee covers:
- The installation of a
RASST Signpost at the specified location
- The attachment of the
appropriate panel or sign
- The attachment of any
requested Riders
- Maintenance of the installed
Signpost as required when
caused by weather damage. Malicious or other damage is not
covered
- Rental of the Signpost,
including Riders and Flyer Boxes if appropriate, for the length
of the initial listing (up to 90 days)
- The removal of all
installed Signposts, Riders and Flyer Boxes at the appropriate time
as notified to RASST

Signpost Extension Fees |
| |
|
Installations which remain installed for a period of more than 90
days will be subject to a monthly signpost rental extension fee (currently
$5 per month or part thereof). The extension fee will be assessed by
determination, at the first day of each month, of signposts which
have been installed longer than 90 days. The appropriate fee will be
added to the respective agent's invoice (Normally at the end of the
next month). |

Timescale |
| |
|
Installations
will be effected the next business day following receipt of the
instruction, providing:
- The instruction is
received by 4 pm on a business day.
- RASST holds the
appropriate signs in inventory.
- The installation is
within the standard area of coverage
- The installation is for
a standard residential Vinyl Signpost
RASST will make every effort
to effect a timely installation of signs that fall outside of these
parameters. |

Signpost Rental |
| |
|
The initial 90
day period of signpost rental is included within the installation fee.
Thereafter a monthly fee (Currently $5 - Jan 06) will be charged
each calendar month until the Signpost is ordered removed or otherwise returned to RASST
inventory |

|
Riders |
| |
|
Up to two Riders
are provided free of rental charge at the time of installation*.
Additional rental Riders will be charged at $5 per rider. Should any
Riders
be requested after initial installation a trip fee will be also charged
for their installation. Should the Riders attached to a Signpost become
damaged (other than weather damage) , lost or stolen the requesting agent will be liable for the
replacement cost of the riders.
* Pending Sale and Sold
riders are excluded from the initial free loan. Pending Sale and
Sold riders may be ordered to be installed on a RASST signpost at
the appropriate time for a reduced fee (currently $8.00). These
riders, as all other riders, remain the property of RASST. |

Ownership
of Signposts, Riders and Flyer Boxes |
| |
|
All Signposts,
Flyer Boxes and Riders remain the property of RASST at all times.
The exceptions to this are:
- If the Flyer Box was not originally
the property of RASST
- If the Rider was not originally the
property of RASST

|
Ownership
of Agent Panels and Damage |
| |
|
All Agent panels remain the property and the responsibility of the
appropriate agent. All agent panels attached to RASST posts are the
sole responsibility of the appropriate agent. Any damage to, loss,
defacement of an agent's panel is the sole responsibility of the
appropriate agent. Any damage or loss due to weather is the sole
responsibility of the appropriate agent. |

Positioning of Sign Posts |
| |
|
It is the
agent's responsibility to clearly mark or explain to RASST where the
sign should be installed at each listing. In the absence of specific
instructions RASST installers will make every effort to ensure that
signs are placed appropriately however, this is at the agent's own
risk. |
| |
|
Directional Signs |
| |
|
Directional
signs may be installed at the client's request. However, the client
is responsible for ensuring that any permissions have been obtained
to place the directional signs. Directional signs are installed at
the client's own risk. Should complaints be received about installed
directional signs then RASST will effect a timely removal but the
full installation
cost will be borne by the requesting agent regardless of the amount
of time the directional sign was in place.
It should be noted that county
and city officials sometimes remove signs and destroy them without
notice. Should this occur then the requesting agent would be
responsible for the full cost of the removed sign and any flyer
boxes or riders.
The requesting agent is also
liable for any fines or fees levied by local and or state
authorities. |

Weather Damage &
Repair |
|
| |
|
RASST will repair, without service charge, any signposts damaged due
to weather. If the signpost is outside the standard service area out
of area fees will apply. While every effort will be made to repair
an agent's panels if damaged, RASST is not responsible for any
damage to an agent's panel or personal riders due to weather or any
other reason. |

Fees Payable |
|
| |
|
All Fees issued by
RASST in the form of an invoice or statement are payable on receipt. |
| |
Unpaid Fees |
|
| |
|
In the event that
an invoice or statement is issued to an agent or agent's
representative for a service which has been provided by RASST and
that invoice or statement remains unpaid for a period of 45 days or
more then the service or services provided by RASST shall
immediately cease at the listing properties to which the invoice or
statement refers and all signposts, riders and Flyer Boxes belonging
to RASST at those properties are subject to immediate removal and
retrieval by RASST. This does not affect any debt recovery action
which may be taken by RASST. |

Moving or
Repositioning of Signposts |
|
| |
|
RASST installers
are normally the only personnel authorized to install or reposition
Signposts. However, Agents may remove Signposts pending the arrival
of a RASST representative provided RASST is informed. Signposts
are rented for one listing at a time and are not transferable.
In the rare event that an Agent should require a "quick self
install" then prior permission must be obtained from RASST and the
full installation fee will apply. Flyer Boxes and Riders are also
subject to the same rules.
If it is determined that RASST signposts
are being moved without the appropriate permission then the
corresponding agent's account is subject to freezing and all
signposts relating to the agent's account are subject to immediate
recovery. |

Agent
Changing Broker |
|
| |
|
When an agent who
has previously had a signpost installed by RASST changes Broker the
following applies: 1. If the agent
still wishes to take advantage of services offered by RASST then
'panel only' changes may be made to an existing signpost. If RASST
carries this out a standard trip charge applies, subject to area.
The initial installation date, under the previous broker, remains
unchanged.
2. If the agent is also changing sign
installation companies a $55 deposit on each currently installed
post and $5 for each rider and $10 for each Flyer Box is required which will be refunded once the post
(and any riders or Flyer Boxes) has been removed and returned to
RASST inventory. If the agent does not wish
to pay the deposit for currently installed signposts, the signposts
will be subject to immediate recovery.

Agent
or Broker Ceasing Service with RASST |
|
| |
|
When an agent or Broker who
has previously had a signpost installed by RASST decides to cease
using the services supplied by RASST the
following applies: If the agent or
brokerage wishes to terminate the services supplied by RASST a $55 deposit on each currently installed
post and $5 for each rider and $10 for each Flyer Box is required which will be refunded once the post
(and any riders or Flyer Boxes) have been
removed and returned to RASST inventory. If the agent does not wish
to pay the deposit for currently installed signposts, the signposts
will be subject to immediate recovery. |

Trip
Charge |
|
| |
|
Trip
charges will be assessed whenever a trip is made at the agents
request which is not covered by normal maintenance as mentioned in
"What is Covered in the Fee" The current
charge (Jan 06) is $12.00. |

Mileage Charge |
|
| |
|
When an
instruction is received which involves traveling out of the standard
area of coverage an extra mileage charge
will apply for each mile outside the standard area. An additional
charge of a pro-rated hourly rate will also be charged. Current (May
11) charges are 50 cents per mile and $18/hr. |
|
Removals |
|
| |
|
Removals are
carried out when the appropriate notification is received by RASST.
It is the agent's responsibility to ensure that the signpost is
available for collection. There is no additional charge for removal
of a RASST installed Signpost unless:
- The Signpost and any
Flyer Boxes or Riders are unavailable for collection when the
RASST representative calls at the listing. The agent will be
notified and subsequent visits to collect Signposts, Flyer
Boxes or Riders will be subject to the standard trip charge.
- The Signposts, Flyer
Boxes or Riders are out of the standard area of coverage. In
which case a mileage/time charge will be applied.
- The removal is anything
other than a standard residential Vinyl Signpost

Agent's Personal Panel
and Rider Storage |
|
|
|
|
| |
|
RASST will store Agent's
residential panels and/or riders at no charge. However, no
responsibility will be assumed for loss or damage to such panels or
riders stored at RASST premises, nor will RASST keep a running
inventory of Agent's personal panels or riders. (RASST will
always, on request, notify Agent's of the number and condition of
their property stored at RASST premises) Whilst every effort is made
by RASST to store the Agent's personal panels or riders in a clean
and safe manner, should Agents wish to take advantage of the free
storage offered by RASST they must accept any and all risks of loss
or damage to their personal property.
NOTE:
If, after a period of 12 months or more, there is no activity on the
agent's account the appropriate panels will be discarded. |

Lost or
Damaged Signs, Riders & Flyer Boxes |
|

|
|
| |
|
RASST operates with the
understanding that the Real Estate Agent rents the Signpost(s),
Flyer Box(es) and Riders for the duration of the Agent’s listing. It
is the Agent's responsibility to ensure that the Signposts, Flyer
Boxes or Riders are properly cared for. Should the Signpost, the
Flyer Box or the Rider be damaged (other than weather damage), lost or stolen then the Agent
will be liable for the replacement cost of the Signpost, Flyer Box
or Riders. Current (Jan 07) replacement costs are:
Sign Post: $65
SP Stake only: $15 Flyer box: $15 Riders: $15 |
